Hi Retail Smart Guys,

When interviewing new candidates, I am looking for future employees that are willing and outgoing.  But any good interviewee can appear willing and outgoing.  I generally ask a candidate back for a 2nd or even 3rd interview, if I feel strongly about potentially hiring them.  My question is:  Can I hire a candidate on a temporary basis...a probationary period, in order to see if they are indeed willing and outgoing, beyond the interview(s)?

Always check with an attorney on hiring procedures.  But we believe it's possible to hire someone temporarily as
at 1099 employee, as long as it is for a very short term project.  There are rules for this, so again check with your
attorney.

This will depend upon the state that your store is in, and the type of employment agreement that you have with the employee.

What state is your store in?
What type of agreement do you have with the employee?
